Thank you once again for your interest in our Traverse City vacation rental properties. In order to be fair to everyone, the following guidelines have been developed to ensure a smooth and pleasant experience.
Online Reservations are encouraged, but rest assured we invite you to call or email us anytime to answer your questions to make sure your Northern Michigan vacation is a grand experience.

ACCEPTANCE OF TERMS & CONDITIONS - By using the online reservation system and by providing credit card information and other requeired information, GUEST agrees that the terms, conditions, limitations and information contained in this temporary LICENSE AGREEMENT have been read carefully and fully accepted by GUEST on behalf of self and all other occupants and all agree to abide by such terms, conditions and limitations. All telephone reservations will require Guest(s) to authorize this Agreement.
RESERVATION DEPOSIT- A Reservation Deposit of 33% of total fees is due at the time of reservation. Reservations made within 60 days of arrival date will require full payment in order to confirm your reservation. Any required paperwork and funds must be received within 7 days of reservation, or reservation is subject to cancellation.
MINIMUM STAY - Rates are based on a minimum number of nights lodging. Longer stays may be required during holidays, peak seasons or specials events.
DAMAGE PROTECTION - All reservations require a $39, non- refundable, damage protection fee. This is collected instead of a traditional damage deposit and will protect guests for any accidental damage or loss up to $3000. Guest must immediately notify Jimmy Mack Vacations to have the damages covered. The policy does not cover acts that are intentional or due to gross negligence, willful or wanton conduct. Theft or damage of any property owned by or brought onto the premises by Guests is not covered under this protection. If malicious or intentional damage occurs, the Guest will be charged to fully replace or repair damage, including any applicable fees. a. No damage is done to unit or its contents, beyond normal wear and tear. b. No charges are incurred due to contraband, pets or collection of funds due during stay. c. All rubbish, trash and discards are placed in appropriate trash receptacles and soiled dishes are placed in the dishwasher and cleaned. d. All keys are relinquished. e. All charges accrued during the stay are paid prior to departure. f. No linens are lost or damaged. g. No early check-in or late check-out. h. GUEST is not evicted by the AGENT/OWNER (or any representative of the owner), the local law enforcement or any security company employed by property or any other person(s) with authority to do so. j. No smoking has taken place in non-smoking properties. If our cleaning partners suspect that any smoking has taken place in the property, a minimum smoke mitigation and cleaning expense fee of $500 will be deducted from damage deposit. No exceptions. Cleaning partner/associate assessment of property condition will dictate.
FALSIFIED RESERVATIONS - We cannot license properties to singles under age 25 unless accompanied by an adult guardian or parent. Penalties exist for any false reservations. Any reservation obtained under false pretense will be subject to 100% forfeiture of reservation deposit and all advance payments and deposits.
PAYMENT SCHEDULE – At the time of reservation, a deposit of 33% of the total fees is collected. The remaining balance is due 60 days before arrival and will be charged to the credit card provided at time of reservation unless you notify us of another form of payment. This notification must be acknowledged in writing by Owner/Agent. Rates are subject to state and local taxes and are subject to change.
CONFIRMATION - A written confirmation of your reservation will be sent upon receipt of the reservation deposit. Please review carefully to verify the property, dates, applicable charges and any special notes. Contact us immediately to report any errors. After 72 hours, the confirmation will be considered accurate.
CANCELLATIONS AND/OR CHANGES - A $50 fee may be charged for multiple changes made to a reservation made by GUEST.
All reservations cancelled sixty (60) days or more prior to your scheduled arrival date will receive full refund of the Reservation Deposit and any advance payments. A cancellation must be in writing and acknowledged by Agent/Owner. Cancellation or early departure does not warrant any refunds.
All reservations that are not paid within sixty (60) days of your scheduled arrival date will be cancelled and all advance payments will be forfeited.
All reservations cancelled sixty (60) days or less prior to your scheduled arrival date will forfeit their advance payments.
The AGENT may cancel a reservation if, in its sole opinion, it is in the best interest of the OWNER. The AGENT abides by all Federal and State Equal Opportunity regulations.
TRAVEL INSURANCE Travel Insurance is highly recommended and automatically quoted with each reservation request at the rate of 7% of total charges, fees and taxes. This coverage protects guests and all travel companions for covered losses incurred because of unforeseen circumstances, illness, injuries and weather related mandatory evacuations. Coverage is available for purchase up to the time of your final payment. However, if paid at the time of initial reservation, the insurance will also cover pre-existing conditions for all guests. You will have 10 days from the date payment is posted to your reservation to decline coverage. All refunds are issued directly from the provider. Once insurance is accepted, it is non-refundable. LONG TERM RESERVATIONS - Long-term reservations are defined as any reservation period of 28 days or longer. Full payment is required within 120 days of your scheduled arrival date. A 120-day notice is required for cancellation. Cancellations that are made more than 120 days prior to your scheduled arrival date will incur no penalty. A cancellation must be in writing and acknowledged by Agent/Owner. Cancellations or changes that result in a shortened stay, that are made within 120 days of the scheduled arrival date, may incur damages if any loss of lodging cannot be replaced by another guest reservation and may result in the forfeit of the full advance payment and damage/reservation deposit. Cancellation or early departure does not warrant any refunds.
PROPERTY ASSIGNMENTS - Owner and/or Agent reserve the right to substitute comparable accommodations without notice or liability should the reserved unit be out of order or not available for ANY reason. When comparable accommodations are not available, guest will have the option of selecting from available properties at the published rate or receiving a complete refund. A comparable property that is unacceptable to the guest is considered a guest CANCELLATION and will be treated accordingly.
CHECK-IN PROCEDURES Where: All guests will receive access keys via overnight delivery from the owner days prior to your scheduled arrival date. If you need them earlier for some reason, please advise as soon as possible. Upon final payment, Arrival Instructions will be provided with complete details.
When: Check-in begins at 4 PM EST for all properties. During Peak season, unavoidable delays may occur
CHECK-OUT PROCEDURES Where: All guests must follow the check-out procedures as outlined in the property, unless otherwise instructed. Lost keys or unreturned keys upon check-out will result in the lock having to be changed and the guest will be charged a minimum of $150.
When: Check-out is at 10 AM EST. In the event that departure is past 10 AM EST, Guest will be charged a $250 fee + $50 per hour beyond the 10 AM EST deadline + any actual expenses incurred to get the property cleaned and ready for the next guest. In the event that late check-out causes disruption for the next Guest, if any, at Owner/Agent sole discretion, Guest may be charged for lost revenues.
OCCUPANCY - The total number of persons allowed in the property, including children, at any time is restricted to the stated sleeping capacity for each property. These numbers are governed by association rules, owner preferences and local ordinances. Sofa and bunk beds are recommended for use by children.
Family groups, couples and responsible adults are welcome. The person checking-in, (i.e. "Responsible Guest"), must be the qualified person that made the reservation. The qualifying person will be required to show identification upon check-in. The qualifying person is responsible for the conduct of all guests and occupants, and must occupy the property for the full term of the reservation. Absolutely no loud parties or illegal activities are allowed. Owner/Agent reserves the right to enter the property anytime to investigate disturbances, occupancy and/or condition of the property. Any violators will be evicted without refund.
DEPARTURE CLEANING FEE - A departure cleaning is included with all week long reservations. Shorter stays may require a departure cleaning fee. Our cleaning includes the stripping and remaking of the beds with fresh linens, light dusting, vacuum and mopping of floors, cleaning and sanitizing bathrooms. If additional cleaning is required after your check-out you will be charged an additional fee at a rate of $50/hr.
LINENS, TOWELS & SUPPLIES - Linens and bath towels are provided and are not to be taken from the property. We suggest you bring beach towels. A starter supply of trash liners, dish detergent, dishwasher powder, laundry soap, paper towels, bath soap and bathroom paper is also provided
GUEST RESPONSIBILITIES - No intentional damage is done to property or its contents, beyond normal wear and tear - All rubbish, trash and discards are placed in garbage receptacle or dumpster, and soiled dishes are placed in the dishwasher and cleaned, and all food removed from refrigerator - All keys are relinquished as directed - All charges accrued during the stay are paid prior to departure - No linens are lost or damaged - No early check-in or late check-out - The guest is not evicted by the Agent/Owner (or any representative of the owner), the local law enforcement or any security company employed by property or any other person(s) with authority to do so. - Leaving property in a neat condition and furniture arranged as upon your arrival - Making sure that no items are missing from the property. - Upon Departure: Setting the thermostat to 78 degrees cool (June thru August) and 62 degrees warm (September to May). - Closing and locking all doors and windows. - Upon arrival, Guest is required to inspect the property for cleanliness or damages. If anything is not acceptable, Guest is required to report this to the Owner/Agent. If no contact is made regarding the condition of the property within 24 hours of arrival, it is assumed that you approve of the condition of the property and no claim can be made otherwise. - No smoking has taken place in non-smoking properties. If cleaning partners suspect that any smoking has taken place in the property, a minimum smoke mitigation and cleaning expense fee of $500 will be charged to credit card on file. No exceptions. - Cleaning partner/associate assessment of property condition will dictate. - If additional expenses are incurred to return property to pre-arrival condition or guest violates any other terms, we reserve the right to charge expenses and administrative fees at a minimum rate of $50/hr and guest hereby authorizes Owner and/or Agent permission to charge the guest's credit card and expressly agrees to not initiate a chargeback or refusal to pay with credit card issuer.
FURNISHINGS - PERSONAL PROPERTY – The vacation rental property is privately-owned and it has been decorated and equipped to satisfy the particular tastes and desires of the Owner. Please be considerate of all property belonging of the owners and future guests. Do not rearrange the furniture, take any items outside that are part of the interior decor, or move any furnishings or kitchen items to another unit. Property descriptions are accurate at the time of release to the public. Subsequent owner renovations may have occurred since that time. Although every effort has been made for accuracy, Owner/Agent is not responsible for errors in this publication for property changes made by owners or for any condition beyond our control upon arrival. Owner/Agent represents the property to the best of his/her ability and assume no liability for minor errors or omissions.
MAINTENANCE – Guest is responsible for reporting any damages or malfunction of equipment to Owner/Agent as soon as possible. Failure to do so may incur some liability to Guest. No compensation will be given for temporary outage of electricity, gas, water, internet, television or telephone service. Efforts will be made to have them restored as soon as possible. The operation and maintenance of these utilities may be outside the control of Owner/Agent. Appliances, air conditioners and hot tubs/jacuzzis are not guaranteed and refunds cannot be given for failure or breakdown. Owner/Agent will attempt to repair or replace any item during your stay. If a part has to be ordered and the item cannot be repaired before your departure, no money will be refunded.
BALCONIES - DECKS - Please understand that ALL CHILDREN MUST BE SUPERVISED WHILE ON ANY BALCONY or DECK.
WATER FEATURES - Guests agree to release and hold harmless Owner/Agent from any and all liability relating to water features, including swimming pools, lakes, hot tubs, rivers, ponds, etc. Guest and all Occupants agree to indemnify Owner/Agent from any liability causes of action and to be responsible for defending Owner/Agent.
POOLS - Pool can be dangerous and in some properties, the hours may be restricted and are subject to change. All children under the age of (12) must be accompanied by an adult at ALL times. No glass is allowed in any pool area.
CHILDREN & GUESTS - Children are welcome in all properties. Responsible GUEST understands that PROPERTIES ARE NOT CHILD-PROOFED and it is the GUEST's responsibility to monitor the activities of all minor children and accept full responsibility for informing all other registered guests of the terms of these documents. In the event of an emergency, local emergency providers require that the names of all registered guests are provided.
PETS - The property selected may or may not be a Pet Friendly Property. Pets are not permitted inside properties under any conditions. Unless your reserved property is a pet friendly property and a pet fee has been paid in advance, any evidence of a pet(s) found on the premises, will result in your immediate eviction with no refund. Guest may also be charged an additional $200 to $600, deep-cleaning fee to restore property. Cleaning partner assessment will be the sole determination after departure.
NON SMOKING PROPERTIES - Smoking is allowed only in Smoke Friendly Properties. Unless your reserved property allows smoking, any evidence of a smoking inside the premises, will result in removal with no refund. Guest may also be charged an additional $200 to $600, deep-cleaning fee to restore property. Cleaning partner assessment will be the sole determination after departure.
PARKING - Parking is restricted to designated parking areas only.
FIREWORKS - The use of fireworks is prohibited on all properties. This is a fire hazard.
LOCK-OUT - In the event a GUEST becomes locked out of a unit, a $25 service fee may be charged during normal working hours for re-entry and $75 service fee for after hours or Sundays.
PARKING PASSES – Parking passes, Access Keys or Codes are provided depending on your selected vacation rental property. Guests must display any issued parking passes on vehicle dashboard at all times. Failure to do so may result in towing of vehicle at your expense.
INCLEMENT WEATHER – Refunds will not be made for inclement weather. In the event of mandatory evacuation by civil authorities, the unused portion of the reservation period will be refunded. No refunds will be given unless: a. The National Weather Service orders mandatory evacuations in the area and/or b. A "mandatory evacuation order" has been given for the area of residence of a vacationing guest. The day that the National Weather Service orders a mandatory evacuation order, we will refund: i. Any unused days from a guest currently registered, ii. Any unused days from a guest that is scheduled to arrive, and wants to shorten their stay, to come in after any evacuation is lifted; and iii. Any advance money collected or deposited for a reservation that is scheduled to arrive during any evacuation period. c. CANCELLATION DUE TO STORM DAMAGE - If we experience damage to the Property due to a storm prior to your arrival, and we need to cancel your reservation, we will refund all deposit payments you have made. We will not be liable to you for any additional charges that you might incur in making changes to your travel plans. d. TRAVEL INSURANCE IS HIGHLY RECOMMENDED. UTILITIES - Utilities are included unless otherwise noted. The climate control system is subject to damage if the thermostat is set for too high or too low of a temperature. If the temperature control unit is damaged as a result of GUEST negligence, excessive damages may result and GUEST will be fully responsible. For your convenience, a telephone is provided in most properties. Local calls are free. Long distance calls may be made collect, charged to your credit card, calling card or to your home phone. Cell phone coverage may not exist on all properties.
RESIDENCES FOR SALE - In the event the vacation property you have reserved is listed for sale, Owner/Agent may need to show the property during your visit. Every effort will be made to schedule the showing at a convenient time with little or no interruption.
AGENCY DISCLOSURE - Jimmy Mack Vacations / Jimmy Mack Property Management is the AGENT of the property owner and acting at all times, in and for the best interest of the Client-Owner(s). GUEST(s) acknowledge that they are a TEMPORARY LICENSEE of the Owner and not a tenant and are not acquiring any leasehold interest in the property, and any rights thereof.
MARKETING AGENT DISCLOSURE: Jimmy Mack Vacations (“JMV”) is acting solely as the marketing agent for this property. All funds collected by JMV will be transferred to the Owner(s). Owner(s) names and contact information will be provided to Guest for future communication, should that be necessary.
SECURITY - GUEST understands that no security is provided. Agent/Owner are NOT liable for injury, damage, violence or otherwise that might happen to the guest while at a property. Owner/Agent will not be held responsible for acts of theft, vandalism or damages to the owner or guest’s personal property.
COMMUNITY PROPERTY - GUEST accepts and agrees to the following in regard to any community facility amenities (FACILITIES): a. GUEST shall ensure that the Facilities are used in a safe manner at all times and that use of the Facilities by minors is supervised by an adult; b. Unsafe and/or unsupervised use of the Facilities by GUEST, minors or persons invited on the premises by GUEST shall permit AGENT/OWNER to terminate immediately WITHOUT NOTICE to GUEST(s), minors and persons invited on the premises, occupancy of the premises; c. GUEST shall indemnify and hold AGENT/OWNER (or its officers, employees, agents and equity holders) harmless from and against any and all liabilities, claims and expenses for personal injury or property damage resulting from unsafe and/or unsupervised use of the Facilities by GUEST(s), minors and/or persons invited on the premises by GUEST.
HOLD HARMLESS – RESPONSIBLE PARTY and all GUESTS agree to indemnify and hold harmless AGENT/Owner from and against any liability for personal injury or property damage sustained by any person (including minors and GUEST’s invitees) as a result of any cause or failure of AGENT/Owner to comply with any governing law or statutes unless caused by negligent or willful act of AGENT or the Owner.
DEFAULT - If Guest defaults in the performance of any of the obligations contained herein, Agent/Owner shall be entitled to recover all costs and expenses as well as court costs and reasonable attorney’s fees.
In the event that Guest does not take possession of the premises or make payments as provided herein, it shall be considered a breach of this License Agreement and Agent/Owner may license the use of the premises to another person(s) without liability on the part of Agent or Owner to Guest. After the License Agreement is authorized, reservation deposits will be returned only if and when Agent is able to license the use of the premises for the original days covered by this License Agreement.
THEFT / INJURY - GUEST hereby acknowledges that they must close and lock all windows and doors of unit when they are away from the property for ANY amount of time. GUEST hereby acknowledges that he/she has been advised of the dangers of water sports and other outdoor activities. All GUESTS all agree to indemnify and save harmless Owner and/or AGENT (its owners, representatives or employees) from any and all liability, negligence on the part of either party, loss, damage, injury or death resulting from the use of the property, its fixtures, contents and facilities. GUESTS hereby acknowledge that he/she has been informed that vacation rental properties are NOT a child-proofed. It is the GUEST’s responsibility to monitor the activities of all minor children in his/her care. GUEST hereby acknowledges that he/she accepts full responsibility for informing all registered guests and invitees of the terms of these documents and waivers, and that any unregistered guests will be considered as trespassers.
ENTIRE AGREEMENT - This document contains the entire agreement and all changes must be made in writing and authorized by the Owner/Agent, and all responsible GUEST(s). The covenants and conditions herein contained shall apply to and bind the heirs, successors, executors, administrators and legal assigns of the parties to this agreement. Guest authorization and/or Online Reservation Request indicates complete agreement with all terms and conditions and responsibility for sharing same with all authorized occupants. Copy, fax or emailed signatures and messages and copies shall also serve as originals for legal purposes.
DAMAGES - In the event that theft or damage occurs to the property, its contents, or other property beyond normal wear and tear during visit by ANY occupant or visitor pursuant to this agreement, and the cost(s) to repair and/or replace damages or theft exceeds the Damage Protection coverage, Guest(s), individually and jointly, whether named on this License Agreement or not, hereby agree that full payment shall be charged to the credit card on file. Guest(s) also agrees that no refusal to pay, or chargeback, shall be initiated by Guest with credit card company. A complete itemization of any additional expenses will be provided to Guest (s). In the event that the cost of any damage is not collected for any reason, Owner/Agent reserve the right to use any all legal remedies available to secure reimbursement for Guest damages.
JURISDICTION - Vacation Properties and license agreement are governed under the legal jurisdiction of county in which property is located. At the sole discretion of the Owner/Agent, Guest and Owner/Agent agree that any dispute between them will be handled by either the county where the property is located, or Owner/Agent's residence jurisdiction. Any claims other than that of non-payment by guest, for occupancy charges or for damages, will be settled by means of binding arbitration.
WRITTEN EXCEPTIONS – Any exceptions to the above mentioned policies must be approved in writing in advance.
GUEST DOCUMENTATION - On or before check-in, you may be required to authorize this document and/or provide a proof of identification. If NOT reserved online, please authorize below and return with the following items: a. One SIGNED copy of this License Agreement b. A copy of your state issued I.D. or driver’s license
AUTHORIZATION OF CHARGES & ACKNOWLEDGEMENT BY RESPONSIBLE PARTY - Guest understands and consents to the use of the credit card provided over the telephone or online reservation system without original signature on a charge slip/receipt. A photocopy of an email confirmation, agreement and/or online reservation request will serve as the original. Guest agrees that authorization for use of credit card for charges due cannot be revoked and will not terminate until 14 days after the property is vacated. A valid credit card must be on file prior to arrival. Guest authorizes use of this credit card and its use for payment of any and all charges due under the terms of this agreement. Acceptance of this email shall constitute a valid and binding acceptance of this confirmation agreement. Time Is Of The Essence with respect to all time periods contained in this agreement. The charge will appear as Jimmy Mack Vacations on or near the dates as detailed above or thereafter, if applicable. On behalf of myself and authorized guests:
